About David C. Reymann

David Reymann specializes in complex commercial litigation and high-stakes business disputes. He has been recognized by Best Lawyers in America for “bet-the-company” litigation and handles cases for local, national, and international clients in both state and federal courts on a wide range of issues, including intellectual property, trade secrets, copyright and trademark, corporate malfeasance, shareholder and member disputes, contract, restrictive covenants, private equity disputes, and business torts. David has handled cases at all levels of state and federal courts, both trial and appellate, in Utah, federal circuit courts, and the United States Supreme Court.

David has particular expertise in First Amendment and media law.  He has represented every news media organization in the state of Utah and multiple national organizations in a wide variety of matters, including defamation, open records, access to court and governmental proceedings, anti-SLAPP (UPEPA) litigation, reporter’s privilege and newsgathering subpoenas, online liability, anonymous speech, privacy, wiretap liability, anonymous sources, copyright, and other related areas.  He has also represented non-media clients in First Amendment cases, including high-profile companies and individuals in defamation and privacy actions and social media companies in constitutional challenges to social media regulation.

David has been named “Lawyer of the Year” in Utah by Best Lawyers six times in the areas of First Amendment Litigation and First Amendment Law.  He was instrumental in the drafting, development, and passage of Utah’s reporter’s shield and anti-SLAPP laws, as well as Utah’s rules allowing cameras in the courtroom.  David is also a registered lobbyist and regularly engages with the Utah legislature on a wide range of issues affecting government transparency and the public’s right to know.  For more than 25 years, David has also staffed the Utah Freedom of Information Hotline at Parr Brown, which provides pro bono assistance to the news media and citizens seeking access to government records and proceedings.  For his work in these areas, the Utah Headliners Chapter of the Society of Professional Journalists has awarded David its Sunshine Award and its Roy B. Gibson Freedom of Information Award (twice), which each recognize extraordinary work on behalf of government transparency and investigative journalism.

David’s constitutional litigation experience extends beyond free speech work.  Over the years, he has also represented voters challenging Utah’s unlawfully gerrymandered congressional districts on state constitutional grounds; direct democracy organizations seeking government reforms through initiatives, referenda, and other ballot measures; churches and ecclesiastical organizations asserting free exercise challenges to state law; and individuals asserting due process and other constitutional violations for unlawful government actions. He has both challenged enacted legislation on constitutional grounds and served as special counsel to the State in defending legislation against constitutional challenges.

David also has extensive experience in litigation involving multi-level marketing, network marketing, and direct-sales companies. He has assisted both companies and distributors in various disputes both nationally and internationally, including trade secret and cross-recruiting cases, anti-pyramid regulation, contract and policy matters, international jurisdiction conflicts, intellectual property, and product contamination issues. In addition to litigation, David advises companies on policies and procedures, contract drafting, and regulatory compliance with an eye toward avoiding litigation.

David has additional experience in environmental and administrative litigation. He has assisted local and national clients in multiple matters at both the agency level and in court, ranging from water use and Clean Water Act compliance, discharge permits, air quality and Clean Air Act compliance, CERCLA, citizen suits, industry challenges to EPA disapprovals of state implementation plans, notices of violation, public trust and sovereign lands litigation, and appeals.

David does a meaningful portion of this work pro bono.  He has always believed that one of a lawyer’s highest callings is to provide legal assistance to those who can least afford it. In addition to the First Amendment, transparency, and defamation defense work described above, David has also represented the wrongfully convicted in multiple post-conviction innocence cases, immigrants whose citizenship applications were unlawfully delayed following the events of 9/11, and a variety of individuals whose civil rights have been violated by legislation or other government actions.  For this work, in 2017 the ACLU of Utah awarded David its Mickey Duncan Award for Excellence in Civil Liberties Advocacy. In 2011, David was also elected by his peers to the Fellows of the American Bar Foundation, an organization limited to one-third of one-percent of the lawyers in America and dedicated to the advancement of social progress in the law.

David is a past President of both the Salt Lake County Bar Association and the David K. Watkiss – Sutherland II Inn of Court, the largest Inn in the country. He is also an adjunct professor at the S.J. Quinney College of Law at the University of Utah, where he has taught litigation practice for the past sixteen years. Best Lawyers has recognized David in six different areas of the law (Bet-the-Company Litigation, Commercial Litigation, First Amendment Litigation, First Amendment Law, Environmental Litigation, and Communications Law).  He is consistently recognized for his accomplishments in Benchmark Litigation, Utah Business magazine’s Legal Elite, Mountain States Super Lawyers, and Martindale-Hubbell.  In 2010, when he was a much younger man, Utah Business magazine profiled David as one of Utah’s “Forty Under 40,” and Super Lawyers more recently featured him in its cover story in July 2024 detailing his First Amendment work.

David grew up in Alabama and greatly misses real southern food. He compensates with Utah’s stellar fly fishing.
