Ms. Kennedy has assisted numerous large corporations, small businesses, and individuals with insurance coverage and recovery and compensation from insurance companies in a variety of disputes, including those involving claims of construction defects, mismanagement, property damage, fraud, negligence, other torts, and contract disputes.  She has extensive experience with Commercial General Liability (“CGL”), Employment Liability (“EPL”), Directors and Officers Liability (“D&O”), Professional Errors and Omissions Liability (E&O”), Property, Umbrella, Excess, and other types of insurance policies, as well as owner controlled insurance programs (“OCIP”) and contractor controlled insurance programs (“CCIP”).

Ms. Kennedy also has significant experience with complex litigation involving businesses and individuals in a broad range of industries and a wide variety of contractual relationships, such as equipment leases, real estate contracts, construction contracts, and health provider-insurer agreements; torts, such as negligence, tortious interference, fraud, and conspiracy; and RICO (Racketeer Influenced and Corrupt Organizations Act) claims.  In addition, she has assisted companies with responding to and resolving demands made in connection with notices of violation of Proposition 65, California’s Safe Drinking Water and Toxic Enforcement Act of 1986.

Before joining the firm, Ms. Kennedy worked for numerous years as a judicial law clerk in the United States District Court of Utah, the Utah Supreme Court, and the Utah Court of Appeals, where she gained valuable insight into the judicial processes of Utah’s state appellate and federal trial courts.

Ms. Kennedy has been a member of the Utah State Bar since 1995 and is licensed to practice law in all state and federal courts in the State of Utah as well as the United States Court of Appeals for the Tenth Circuit and the Supreme Court of the United States.
